Order Terms and Conditions

These Order Terms and Conditions (“Terms”) govern the placement of Orders (“Order”) with Wavertech Ltd. (“we,” “us,” or “Wavertech Ltd.”) for our products and related accessories (“Products”). By submitting an Order, you acknowledge that you have read, understood, and agree to be bound by these Terms.

 

1. Order Reservation
When placing an Order, you must provide accurate and up-to-date information, including your billing and shipping details. You warrant the accuracy of this information and accept responsibility for keeping it current. Wavertech Ltd. is not liable for delays or errors resulting from outdated or incorrect information. You may update your details prior to shipment by contacting sales@wavertech.com.

We reserve the right to decline or delay Orders, including to prevent oversubscription. In such cases, we will notify you within two (2) weeks of receiving your Order, and you will be entitled to a full refund of the purchase price. Refunds will be processed to your original payment method within 14 days of notification.

 

2. Payment
The full price of the Products will be charged at the time you place your Order. If Wavertech Ltd. cannot ship the Products within one (1) month of your Order date, you will receive a full refund. Refunds will be issued to the original payment method. By placing an Order, you expressly authorize Wavertech Ltd. to process payment immediately.

All payments are processed in EUR, and customers are responsible for any currency conversion or international transaction fees imposed by their payment provider.

 

3. Priority
Orders are shipped on a first-come, first-served basis. Your position in the queue does not guarantee receipt of a specific Product serial number or identifier. Please refer to our website or newsletters for updates on shipping timelines.

 

4. Delivery Schedule
While we strive to fulfill Orders promptly, delivery dates are estimates and subject to change. Wavertech Ltd. does not guarantee shipment by any specific date and is not liable for delays. Delays do not entitle you to discounts, refunds, or credits beyond what is expressly stated in these Terms. Periodic updates regarding delivery schedules will be provided.

Wavertech Ltd. is not liable for delays caused by circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, or government regulations.

 

5. Pricing
The price for your Order is confirmed at the time of purchase and remains valid until the Product is delivered.

 

6. Returns
You may return Products within 14 days of delivery, provided they are unused, in new condition, and the original packaging remains sealed. If you believe the Product is faulty, contact Wavertech Ltd. within this 14-day period for troubleshooting and, if necessary, request a return authorization. Returns must comply with our Returns and Warranty Policy, which can be found on our website.

Return shipping costs are the responsibility of the customer unless the Product is deemed faulty upon inspection. Returns outside this period will not be accepted.

 

7. Limitation of Liability
Wavertech Ltd. is not liable for incidental, special, or consequential damages arising from these Terms or your Order. Wavertech Ltd.’s total liability for any claims, whether in contract, tort, or otherwise, shall not exceed the amount paid by you for the Product giving rise to the claim. Your sole and exclusive remedy is a full refund of the purchase price, excluding interest.

 

8. Terms and Conditions of Sale
The purchase of Products is subject to additional terms provided by Wavertech Ltd., including those related to software, intellectual property, and data collection. These terms are available on our Order page and may be updated without notice. Your purchase signifies acceptance of these terms and any applicable refund policy.

 

9. Age and Residency
By placing an Order, you confirm that you are at least 18 years old. Wavertech Ltd. may limit service availability to specific geographic regions as determined by our business strategy.

 

10. Customer Information
All information collected during the order process is handled in compliance with our Privacy Policy, Website Terms, and applicable data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
By placing an order, you consent to Wavertech Ltd. occasionally featuring your company name or logo in promotional materials, such as client lists or portfolio showcases on our website. This inclusion is solely intended to represent our customer base and does not imply endorsement, partnership, or any further engagement. Wavertech Ltd. does not derive any direct benefit from this usage. If you prefer not to be included, simply write “OPT-OUT” in the notes section of your order or contact us directly. Upon request, we will promptly remove your details from our records.

Under GDPR and CCPA, you have the right to:

  • Access the information we collect and use about you.
  • Request corrections or updates to ensure the information is accurate and up-to-date.
  • Request removal of your information from our records at any time.

11. Amendments to Terms
Wavertech Ltd. reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Continued use of our services constitutes acceptance of the updated Terms.

 

12. Miscellaneous Provisions

  • Entire Agreement: These Terms represent the entire agreement between the parties and supersede all prior agreements, understandings, or representations, whether written or oral.
  • Governing Law: These Terms are governed by and construed in accordance with the laws of Bulgaria and the European Union.
  • Jurisdiction: Any disputes arising out of or related to these Terms, including their interpretation, performance, or breach, shall first be resolved through good-faith mediation or binding arbitration in Sofia, Bulgaria, in accordance with the rules of the Arbitration Court at the Bulgarian Chamber of Commerce and Industry (BCCI). If mediation or arbitration fails or is deemed unenforceable, the dispute shall be exclusively resolved in the courts of Sofia, Bulgaria. The governing law for these Terms shall be the laws of the Republic of Bulgaria, without regard to its conflict of laws principles. All court proceedings shall be conducted in Bulgarian. If either party does not understand Bulgarian, certified translation services shall be used, with costs to be borne by the requesting party unless otherwise determined by the court or arbitrator.
  • Non-Assignability: You may not assign this Agreement or transfer any rights under it without the prior written consent of Wavertech Ltd.
