Order Terms
These Order Terms and Conditions (“Terms”) govern the placement of orders (“Order”) with Wavertech Ltd. (“we,” “us,” or “Wavertech Ltd.”) for hardware products, accessories, and related items (“Products”). By submitting an Order, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Order Reservation
When placing an Order, you must provide accurate and up-to-date billing and shipping information. You are responsible for ensuring the accuracy of this information. Wavertech Ltd. is not responsible for delays, losses, or errors resulting from incorrect or incomplete details. You may update your information prior to shipment by contacting [email protected].
We reserve the right to decline or delay Orders, including due to limited availability or risk and fraud screening. If an Order is declined after payment, amounts paid will be refunded to the original payment method within fourteen (14) days. Refund timing may vary depending on your payment provider.
2. Payment
Payment in full is required at the time an Order is placed, unless otherwise stated on the order page. If Wavertech Ltd. is unable to ship the Products within one (1) month of the Order date, you may request a full refund. Payments are processed in EUR. Any currency conversion, bank, or international transaction fees are the responsibility of the customer.
3. Priority
Orders are fulfilled on a first-come, first-served basis. Order sequence does not guarantee a specific serial number, production batch, or identifier.
4. Delivery Schedule, Duties, and Import Requirements
Delivery dates are estimates only. Wavertech Ltd. does not guarantee shipment by any specific date and is not liable for delays. Customers are responsible for all applicable customs duties, import taxes, clearance fees, and local regulatory approvals in their jurisdiction. Wavertech Ltd. is not responsible for delays caused by carriers, customs procedures, or governmental actions.
Wavertech Ltd. is not liable for delays caused by circumstances beyond its reasonable control, including natural disasters, pandemics, supply chain disruptions, carrier delays, or government regulations.
5. Pricing
Prices are confirmed at the time of purchase and remain valid until delivery, unless an Order is cancelled and refunded.
6. Returns and Warranty
Return eligibility and warranty service are governed by our Returns and Warranty Policy published on our website and may vary by product category and destination. Unless otherwise required by mandatory local law, Products must be returned in good condition with all included items and packaging. Return shipping costs are the responsibility of the customer unless the Product is confirmed to be defective under our warranty terms.
EU/EEA/UK consumers: If you are purchasing as a consumer (not a business) and your delivery address is in the EU/EEA or the United Kingdom, you may have statutory withdrawal or cancellation rights for distance purchases. Such rights apply as required by local mandatory law and may include deductions for diminished value where permitted.
Nothing in these Terms limits mandatory consumer rights that cannot be waived under applicable law.
7. Limitation of Liability
To the maximum extent permitted by law, Wavertech Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising from these Terms, an Order, or use of the Products (including loss of profits, loss of business, loss of data, or business interruption).
Wavertech Ltd.’s total aggregate liability for any claim shall not exceed the amount paid by you for the Product giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for willful misconduct or gross negligence where such limitations are not permitted.
8. Software and License Terms
Use of Products may be subject to applicable end user license agreements (EULAs) and software terms provided with the Products or by applicable licensors. Embedded firmware and device software are governed by the WAVER OS EULA and related documentation.
9. Age and Eligibility
By placing an Order, you confirm that you are at least eighteen (18) years old and legally able to enter into these Terms.
10. Customer Information and Data Protection
Personal data collected during the order process is handled in accordance with our Privacy Policy and applicable data protection laws, including the GDPR where applicable.
Wavertech Ltd. may reference customer names (and, where applicable, logos) in customer lists or portfolio materials based on legitimate business interests. You may object at any time by contacting [email protected], and we will make reasonable efforts to remove such references.
11. Amendments
Wavertech Ltd. may update these Terms from time to time. Changes will apply prospectively and will be published on our website.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria and applicable European Union law. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sofia, Bulgaria. Nothing in this clause limits mandatory consumer rights under applicable law.
