These Terms of Service (the “Terms”) govern your access to and use of the websites operated by Wavertech Ltd. (“Wavertech”, “we”, “us” or “our”), including wavertech.com and docs.wavertech.com (the “Website”). Our products and services are governed by separate documents:

• Order Terms: purchases of hardware and accessories from our online store;
• WAVER OS End User Licence Agreement: the software pre-installed on WAVER devices and any firmware updates;
• Privacy Policy, Cookie Policy and Security and Vulnerability Disclosure Policy; and
• WAVER+ Terms and Conditions and the PointX CM Terms and Conditions: accepted when you register for those services.

By accessing or using the Website, you agree to these Terms. If you do not agree, you must not use the Website.

3. Intellectual Property and Permitted Use

All content on the Website, including text, images, documentation, software and logos, is protected by copyright, trademark and other intellectual property rights and is owned by Wavertech Ltd. or its licensors. WAVER, Wavertech and related names and logos are trademarks of Wavertech Ltd. or their respective owners.

You may view, download and print materials from the Website for your own informational and internal business purposes, including the installation and operation of WAVER products. You may not:

• modify, reproduce or redistribute the materials for commercial purposes without our prior written consent;
• remove any copyright or proprietary notices;
• decompile or reverse-engineer any software published on the Website, except as permitted by mandatory law;
• mirror the materials on another server; or
• use the Website for any unlawful purpose or in any way that may impair its operation or security.

Security testing of the Website is permitted only in accordance with our Security and Vulnerability Disclosure Policy.

5. Customer Responsibility for Deployments

WAVER products provide networking hardware and software for guest access, authentication, analytics and engagement. Their features and behaviour depend on the customer’s configuration and deployment environment.

When deploying WAVER products, the customer acts as the data controller and is solely responsible for the lawful collection and use of personal data, obtaining any required consents, defining retention policies and complying with all applicable laws, including the GDPR. Payment processing, messaging and other third-party integrations are provided by independent third parties under their own terms.

Wavertech Ltd. does not provide legal advice and does not warrant that any particular deployment, configuration or use of WAVER products complies with the laws applicable to the customer. This does not affect our obligations as a manufacturer, including the conformity of our products with applicable EU product legislation.

6. No Network or Internet Services

Wavertech Ltd. is a manufacturer of networking hardware and software. We do not provide internet access, network operation, telecommunications services or managed connectivity. The deployment, configuration, operation and maintenance of networks using WAVER products are the sole responsibility of the customer or its chosen service provider.

The Website may contain links to third-party websites. We are not responsible for their content or privacy practices, and the inclusion of a link does not imply endorsement. Your use of any linked website is subject to that third party’s terms and policies.

8. Disclaimer

The Website and its materials are provided “as is” and “as available”. To the extent permitted by applicable law, Wavertech Ltd. makes no warranties, express or implied, regarding the Website or its materials, including as to their accuracy, completeness, availability or fitness for a particular purpose.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Sofia, Bulgaria. We will make reasonable efforts to resolve any dispute amicably before initiating legal proceedings.

If you are a consumer, this clause does not deprive you of the protection of the mandatory laws of your country of residence or of your right to bring proceedings before the courts of that country.
